Terms of Service

These Terms of Service govern your use of Swipe, operated by SparkPoint Technologies. Please read them carefully before using the platform.

1. Acceptance of Terms

By creating an account or using Swipe, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

We may update these terms from time to time. Continued use of Swipe after changes take effect means you accept the updated terms. We will notify you of significant changes by email or in-app notice.

2. Your Account

You must be at least 18 years old to create a Swipe account. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.

You are responsible for maintaining the security of your account credentials. Do not share your password. Notify us immediately at support@swipe.ltd if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these terms or that engage in fraudulent activity.

3. Your Business Page

Swipe grants you a non-exclusive, non-transferable license to use the platform to create and publish your business page at a unique URL (e.g. swipe.ltd/your-name).

You retain full ownership of the content you publish. By publishing content on Swipe, you grant us a limited license to host, display, and deliver it to visitors of your page.

Your public page is accessible to anyone. You are solely responsible for the accuracy and legality of all content you publish.

4. Acceptable Use

You agree not to use Swipe to publish content that is illegal, harmful, threatening, abusive, defamatory, obscene, or that infringes on the intellectual property rights of others.

You may not use Swipe to conduct or facilitate scams, phishing, spam, or any deceptive or fraudulent activity.

You may not attempt to reverse engineer, hack, overload, or otherwise interfere with the platform or its infrastructure.

Violation of these rules may result in immediate suspension or termination of your account without notice.

5. Payments and Billing

Swipe offers free and paid subscription plans. Paid plan features are described on our pricing page. We reserve the right to change pricing with reasonable notice.

If you accept payments from customers through your Swipe page (e.g. Mobile Money), you are responsible for complying with all applicable laws and regulations, including tax obligations.

Subscription fees are billed in advance and are non-refundable, except where required by applicable law.

6. Intellectual Property

Swipe and its logos, design, code, and platform content are owned by SparkPoint Technologies and protected by intellectual property laws. You may not copy, modify, or distribute them without our written permission.

You retain all ownership rights to content you create. We do not claim any ownership over your business name, branding, photos, or service descriptions.

7. Availability and Uptime

We strive to keep Swipe available at all times, but we do not guarantee uninterrupted access. We may perform scheduled maintenance or make changes to the platform at any time.

We are not liable for any loss or inconvenience caused by downtime, data loss, or platform errors, except as required by applicable law.

8. Termination

You can close your account at any time from your account settings. Upon account deletion, your public page will be taken offline and your data will be deleted within 30 days.

We may suspend or terminate your account at any time if you violate these terms, or if we determine that continued access would be harmful to the platform or other users.

9. Limitation of Liability

To the fullest extent permitted by law, Swipe and its team are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

Our total liability for any claim related to Swipe is limited to the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These terms are governed by the laws of Ghana. Any disputes will be resolved through the courts of Ghana.
